  32. AGREEMENT
  34. Submission of this application constitutes an agreement to the following conditions.
  36. (A) The property owner and/or authorized applicant/donor agrees to pay half of tree acquisition cost incurred for his/her property or $100 (whichever is greater); the Greenspace Conservation Commission agrees to pay the remainder of said costs from The Ricketts Environmental Trust (T.R.E.E.); and the City of Madison agrees to provide the labor for tree installation;
  38. (B) The property owner agrees to indemnify the City and its agents and employees access to his/her property for the purpose of tree installation;
  40. (C) The property owner agrees to maintain TREE program tree(s) in a healthy condition for the tree(s) natural life span (Note: A water bag will be supplied during tree installation.); and
  42. (D) The property owner understands that no tree purchase(s) and/or planting(s) shall occur prior to the submittal of cash or check for the acquisition cost(s) stated in a notification lesser issued at the end of the year’s application cycle.
